Facility Use Agreement - Addendum

 

The facility user (group, organization, individual) expressly agrees and understands that the facility user (group, organization, individual) is entering The Oconomowoc Area School District at their own risk to engage in the activities as stated by the formal request on the Facilities Use Agreement. The facility user (group, organization, individual) understands the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization (WHO).  Further, the facility user (group, organization, individual) acknowledges that COVID-19 cases have been confirmed in Waukesha County, Wisconsin and surrounding counties. 

In accordance with guidance issued by the WHO, the United States Centers for Disease Control and Prevention (CDC), and the Wisconsin Department of Health Services (WDHS), for slowing the transmission of COVID-19, the facility user (group, organization, individual) hereby agrees, represents, and warrants that the facility user (group, organization, individual) shall not enter District facilities and engage in the foregoing activities within 14 days after (i) returning from international, cruise ship, and/or riverboat travel as recommended by the CDC  and Wisconsin DHS, or (ii) exposure to any person who is exhibiting symptoms of COVID-19 or has a confirmed case of COVID-19. 

The facility user (group, organization, individual) hereby agrees, represents, and warrants to not enter or allow participants/members to enter District property if they (i) experience symptoms of COVID-19, including, without limitation, fever, cough, or shortness of breath; (ii) have a suspect or diagnosed/confirmed case of COVID-19; or (iii) returned within 14 days from international, cruise ship, and/or riverboat travel as recommended by the CDC  and Wisconsin DHS. The facility user (group, organization, individual) also agrees to notify all participants/members of the aforementioned requirements and implement a means to ensure understanding and compliance.    The facility user may require appropriate waivers for members/participants (Adults and Minors), and it is the responsibility of the facility user (group, organization, individual) to keep all waivers for at least two years and make available to the District upon request.     

It is further understood that the facility user (group, organization, individual) will take all reasonable steps recommended as guidance and protocols issued by the Public Health Agencies for slowing the transmission of COVID-19, including, without limitations, guidance issued by the WHO, the United States Centers for Disease Control and Prevention (CDC), and the Wisconsin Department of Health Services (WDHS), for slowing the transmission of COVID-19, including but not limited to practicing social distancing, wearing face coverings, washing of hands, restrictions on group size and any other appropriate measures required to slow the spread of the Covid-19 Pandemic. Full responsibility to keep up with these ever-changing requirements and or guidelines is the responsibility of the facility user (group, organization, individual) and the District at no time will take on any ensuing liability.   

If the facility user (group, organization, individual) is notified or becomes aware of the fact that one or more of its group contracts Covid-19, or had Covid-19 while being on School property, they MUST immediately (as soon as practical but no later than 24 hours of initial knowledge) report this to the OASD, as well as to local health officials as required by State and local health authorities. If the District needs to shut-down for a short time period because of the need to sanitize due to a positive Covid-19 test on-premise, they will not be responsible for any loss of revenue to any organization whatsoever.
